“My landlord increased the rent illegally” — what to do
If a proposed increase breaks the rules, it isn't enforceable. Here's how to confirm that and push back, calmly and on solid ground.

Step 1 — Confirm it's actually illegal
Run the numbers in the Rent Increase Calculator. If your verdict says the proposed rent is above the legal maximum, you have a clear case. An increase is also invalid if it lands in your first lease year, or if the landlord gave less than 90 days' written notice.
Step 2 — Reply in writing
Tell your landlord, in writing, that the proposed increase exceeds the Decree 43 cap for your index position, and that you'll renew at the legal maximum (or the existing rent, if no valid notice was given). Keep it factual and dated — this becomes evidence.
Step 3 — Hold your position
A demand above the cap is not enforceable. You can keep paying the existing rent. Refusing an unlawful increase is not a valid ground for eviction.
Step 4 — File at the RDC if needed
If the landlord won't back down, take it to the Rental Disputes Center with your Ejari, contract, the index figure and your correspondence. Most rental cases are heard quickly.

Common questions
My landlord increased my rent above the legal cap — is that allowed?
No. An increase above the Decree 43 maximum for your index position is not enforceable. You can decline it, keep paying the existing rent, and file at the RDC if the landlord insists.
What if I didn't get 90 days' notice?
Without 90 days' written notice before renewal, the rent (and other terms) stay the same for the next term. The proposed increase simply doesn't take effect.
Can my landlord evict me for refusing an illegal increase?
